1. Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you and Baitham Labs governing your access to and use of our website and software applications (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 16 years old and have the legal capacity to enter into these Terms. By using the Services you represent that you meet these requirements.
3. Accounts and Connected Services
Some features require you to connect a third-party account. You are responsible for maintaining the security of your credentials and for all activity carried out through your connections. You may disconnect an account at any time, and should notify us of any unauthorised use.
4. Use of the Services
You agree to use the Services lawfully. You must not:
- Use the Services to publish unlawful, infringing or abusive content;
- Attempt to gain unauthorised access to any system or account;
- Interfere with or disrupt the integrity or performance of the Services;
- Use the Services in breach of any connected platform's own terms.
5. Intellectual Property
The Services and their original content are owned by us and protected by applicable intellectual property law. Open-source projects we publish are governed by the licence stated in their respective repositories, which takes precedence over these Terms for that code.
6. User Content
You retain ownership of content you create or upload. You grant us only the limited permission needed to store, process and transmit that content in order to provide the Services. You are solely responsible for your content and for holding the rights necessary to publish it.
7. Third-Party Services and Links
The Services integrate with and link to third-party platforms. We do not control those platforms and are not responsible for their content, policies or availability. Your use of them is governed by their own terms.
8. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. These are experimental projects and may be modified, interrupted or discontinued at any time without notice.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising out of your use of or inability to use the Services.
10. Indemnification
You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, arising out of your use of the Services, your content, or your breach of these Terms.
11. Termination
We may suspend or terminate access to the Services at any time, with or without notice, including where these Terms have been breached. You may stop using the Services and disconnect any linked accounts at any time.
12. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. The parties will attempt in good faith to resolve any dispute informally before pursuing formal proceedings.
13. General Provisions
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a right does not waive it. We are not liable for failure to perform due to causes beyond our reasonable control. These Terms constitute the entire agreement between you and us regarding the Services.
14. Changes to These Terms
We may revise these Terms from time to time. The date at the top of this page will be updated accordingly, and continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
